By using the Site, you agree to be bound by these terms and conditions. If you do not accept the terms and conditions, you are not authorized to use the Site.
These general conditions of use define the conditions under which users may access and use the OUIGEM Service.
The present document is a contract concluded between the user of the OUIGEM Service, whatever his profile: private individual, non-professional, and professional (the "User" or "You") and the Company (the "Party" or the "Parties").
1-Registration and user account :
Registration on the Site is required to access certain functionalities such as the publication of job offers or the publication of CVs. When registering, you must provide true, accurate, up-to-date and complete information about yourself and/or your company.
2- Publication of job offers :
Employers may publish job offers on the Site in return for payment. Payment is made by credit card via Stripe. Job offers must not contain any illegal, offensive, discriminatory or otherwise objectionable content. The Site reserves the right to withdraw any job offer that does not comply with these conditions.
3-CV publication :
Candidates can publish their profiles (CVs) in the CVthèque section free of charge. Publication is anonymous, and only the candidate's title and know-how are highlighted. Companies can pay for access to the CVthèque. Payment is made by credit card via Stripe. CVs must not contain any illegal, offensive, discriminatory or otherwise objectionable content. The Site reserves the right to remove any CV that does not comply with these conditions.
4- Liability
Any complaints regarding published content should be addressed to contact@ouigem.com. The Site reserves the right to remove any content that does not comply with these terms and conditions.
We cannot be held liable for your use of the OUIGEM Site and Service. We cannot be held liable for simple errors or omissions which may have occurred despite all the precautions taken in the presentation of the OUIGEM Service. We cannot be held responsible for any damage resulting from the use of the Service. Use of the OUIGEM Service is at your own risk.
The Company shall in no event be held liable for any consequences that may arise during, or as a result of, meetings or contacts between Candidates and Recruiters, following the use of the OUIGEM Site and Service.
The purpose of the Company is to enable Candidates to publish their CVs and related content, to search for a job and to create a profile that will enable them to benefit from visibility with Recruiters.
Finally, it should be noted that we are not involved in the candidate selection process. Consequently, the Company can in no way be considered as an employer, a professional organization, a recruitment agency or a headhunter, or as an agent of the latter.
The purpose of the Company is to give visibility to companies wishing to publish their profiles in the "Your story" section as well as in the "Professionals & events" section.
OUIGEM is not responsible for the information published in the "Your story" and "Professionals & events" sections.
4.1 Content imported via the Platform
We have no control over :
- User Content imported or published via the OUIGEM Site (its legality, suitability, accuracy, relevance or timeliness). Any opinions expressed through published content are the sole responsibility of their authors;
- The capacity or quality of the Recruiters or Candidates.
We cannot be held responsible for imported User Content. The User is solely responsible for said Content, and the Company's role is that of a technical host for said Content.
The Company has no general obligation to monitor data and User Content, nor any obligation to delete content that does not appear manifestly illicit, notwithstanding its notification.
4.2 Hypertext links
The OUIGEM site may include hypertext links to third-party websites, including the sites of commercial partners. We shall in no way be held responsible for any direct and/or indirect damage that may result from the use of content, data or information of any kind, accessible from the said hypertext links. It is your responsibility to check that the information on these partner websites is accurate, complete and compliant with regulations. These terms and conditions do not apply to third-party sites.
4.3 Internet network and data loss
You acknowledge and accept that the Internet, and more generally any telematic network used for data transmission purposes, may involve risks linked to the lack of protection of certain data against possible misappropriation and risks of contamination by viruses. Therefore, we cannot be held liable for any loss or alteration of data, loss of profit, loss of sales, loss of opportunity, loss of time or any indirect damage, whether such loss or damage is due to negligence or any other cause, in connection with the performance or non-performance of the Terms of Use.
5- Modifications to the general terms and conditions
The Site reserves the right to modify these terms and conditions at any time. Changes will be effective immediately upon posting on the Site. Your continued use of the Site following the posting of changes constitutes your acceptance of those changes.
6- Applicable law and jurisdiction
these terms of use are governed by french law.
in the event of a dispute, the parties agree, in the first instance, to attempt to resolve it amicably. should this fail, all disputes that may arise between the parties relating to the signature, interpretation, execution and termination of the present terms and conditions shall be submitted to the exclusive jurisdiction of the french courts, to which the parties expressly confer jurisdiction, even in the event of multiple defendants, in referee proceedings, in warranty proceedings or by petition.
7- Duration and termination
The Contract is concluded for an indefinite period from the User's acceptance of the Terms of Use.
The Company may immediately suspend access to the OUIGEM Site and Service by operation of law, in the event of non-compliance with the Terms of Use by the User. In this case, the Company will notify the User of the suspension by e-mail, and will give the User formal notice to cease the violation. At the end of a period of ten (10) days from the date of this notification, which has remained without effect, the Company may block access to the OUIGEM Service to the User at fault, without formality and without prejudice to any damages and interest to which it may be entitled in compensation for the damage suffered.
Furthermore, users may cancel their user account at any time by contacting contact@ouigem.com. However, payments made for the publication of job offers and company profiles in the "Your Story" and "Events & Professionals" sections will not be reimbursed.
8-Confidentiality
The Site respects the privacy of its users and is committed to protecting the personal information collected during registration or use of the Site. The information collected will only be used to provide the services of the Site, and will not be shared with third parties without your explicit consent. Please consult our privacy policy for more information on how we handle personal data.
9-Intellectual property rights
Without prejudice to any specific provision of these Terms and Conditions, all copyrights, such as trademarks, patents and design rights associated with this Web site are the exclusive property of the Owner or its licensors and are subject to protection under applicable laws or international treaties relating to intellectual property.
All trademarks - whether nominal or figurative - and any other marks, trade names, word marks, illustrations, images, or logos appearing in connection with this Web site are, and shall remain, the exclusive property of the Owner or its licensors and are subject to protection under applicable laws or international treaties relating to intellectual property.
10-Entire contract
The Terms of Use, including the Preamble, the Privacy Policy and the Terms of Sale, constitute the entire agreement between the Parties.
